»The Reservation of Human Decisions in the Employment Relationship. On the Use of »Artificial Intelligence« in Decision-Making Processes under Labour Law«: The use of »Artificial Intelligence« (AI) in decision-making processes under labour law leads to an algorithmic external determination of the employee, which finds its limits in Art. 22 GDPR. The paper assesses the potential to algorithmize classic employer decisions, elaborates upon the requirements to prevent a »solely« automated process in the case of AI-based decision preparations and analyses the safeguards under individual and works constitutional law.
