The on the one hand partially concealed, partially apparent loss of parliamentary control capability and the on the other hand increasing preponderance of the government in essential sociopolitical affairs (eg abandonment of nuclear power, suppression of terrorism) is becoming more and more frequently criticized because these factors increasingly ousted the Parliament from the center of political power. The essay investigates the reasons behind this development and arrives at an evaluation of these occurrences via the analysis of the significance of the parliamentary decision making process and the function of legislation. In the opinion of the author, the "open society of the lawmaker" and the tendency towards "deinstitutionalization" of legislation are especially capable of endangering the freedom as well as the equality of the citizenry.
