»Case Management by Civil Law Judges«: The civil process has structural deficiencies that cannot be explained by external factors alone. Instead, human weaknesses of the judges have to be taken into consideration as well. The paper therefore suggests a reform of the ZPO which aims to hold the parties more accountable. This goal is to be achieved through a mandatory case management conference, for the preparation of which the court has to draw up the terms of reference.
